Upon the terms and conditions herein stated, this vacation rental agreement (Agreement)
is entered into between Marsha Marks (Owner) and the responsible party (Guest) identified
below:

1) Check-in Time: 4:00 p.m. EST or after. Earlier check-in should not be anticipated unless
arranged in advance.
2) Check-out Time: BEFORE 10:00 a.m. EST, in order to allow preparation of our home for the
next family. Late check-outs will forfeit ALL of the damage/security deposit unless
late check-out has been arranged in advance.
3) Prepayment Required for Reservation: We require a minimum prepayment of 50% of the
total due at the time of reservation. The prepayment will be applied
towards the rental. The pre-payment is a reservation deposit.
4) Method of Payment: We only accept VISA, and MasterCard.
5) Cancellation Policy:NO REFUND is given of the reservation deposit. However, we understand emergencies happen, and will release you of the balance of your reservation should you need to cancel if theIf the property cancelation is more than 30 days out. After 30 days, the full amount is due and is not refundable. If the house becomes destroyed or unavailable for use for any reason that prevents
the Guest stay, this agreement will become null and void and all fees and charges will be
refunded to the Guest, and Guest agrees to release Owner, his agents or employees against any
further claim.
6) Reservation Changes: A "reservation change" is defined as a change of dates (extending an
existing reservation one or several days is not considered as a "reservation change" provided the
extension does not intrude into a future existing reservation). One "reservation change" is
allowed, subject to availability and provided that the change is made at least 30 days prior to the
scheduled date of arrival. Reservation changes conflicting with future existing reservations are
subject to resolution between the reserving parties and no guarantees of changes are possible
pending arrangements between the prospective rental parties. All reservations for use are made
on a first-come first-served basis.
7) Access to Property: Guest will be provided with access codes to the lock box prior to
check in. The access code will give you one key to the house and the other keys will be just inside the front door to the left. Lost keys are subject to a $25.00 fine per key.

8) Age Restriction: No reservations will be made for vacationing students or any singles under
25 years of age unless accompanied by an adult legal guardian or parent responsible for the
rental during the entire stay. Restrictions may apply regarding the number of people that may
accompany a parent or legal guardian. Chaperoned groups are prohibited.
9) Security Deposit: Reservations require a security deposit made in advance in the form of
credit card charge in the amount of $ 500.00. This deposit will be refunded
in the same manner as the deposit. provided that there is no
reason to assess any charges to the deposit. No charges to the security/damage deposit will be
made providing that the following provisions are met:
a. No damage is done to the property or its contents beyond normal wear and tear; no
contents are missing from the property, including linens, cookware, or other items.
b. No charges are incurred due to contraband, pets, long distance phone calls, Pay Per View
TV, or collection of rents or services rendered during the stay.
c. All debris, rubbish and discards are placed in the proper containers, and soiled dishes are
placed in the dishwasher and cleaned.
d. No nuisance or disturbance calls by the Tybee Island Police Department remain unresolved;
e. All charges accrued during the stay are paid prior to departure.
f. All sheets are stripped from all beds and placed on laundry room floor.
Please be aware that the home is inventoried and inspected before and after each guest's occupancy.
10) Deposit Returns: Your security deposit will be refunded withing 15 working days of departure HOWEVER to receive refund, you must call owner @ 912.596.5532 and provide Credit Card number for refund!
11) Telephone Usage: Our phone allows free long distance within the United States. You must use a calling card or a credit card in order to place other long distances calls. Guests assume full responsibility for calls placed or received during guest's stay. Long distance
charges placed on the phone will be assessed at double cost against the security deposit.
12) Maid service: While linens and bath towels are included in your arrival at the property,
continuing housekeeping service is not included. Please note that if your stay
exceeds 14 days, an interim house cleaning fee of $ 150.00 will apply. Normally, the final cleaning fee will be deducted from your security deposit unless other arrangements are made in advance.

13) Special Terms: You will be asked to vacate immediately, with no refund, if any of the
following occur during your stay:
a. Parties of any type. This includes Wedding Parties, Dinner parties, or Birthday parties, or allowing any guests which exceed the home sleeping capacity (14 …except with properly approved City Permit) or excessive noise or rambunctiousness, and/or multiple visits by Tybee Island Police Department;
b. More than the maximum number of guests allowed.; or any guests in the home or on the premises not listed on the rental agreement.
c. Campers, trailers or motor homes, if used or lived-in, including excessive street parking;
d. Using fireworks or firecrackers;
e. Bonfires on decks or porches;.
f. Rentals obtained under false pretense or misrepresentation;
g. Smoking inside the home.
14) Pet Policy: Pets are only permitted with prior written notice.
15) Smoking Restrictions: Smoking is not permitted inside the home.
16) Falsified Reservations: Any reservation obtained under false pretense will be subject to
forfeiture of prepayment, deposit, and/or rental monies and the party will not be permitted to
check in.
17) EXTRAS (APPLIANCES): Televisions, VCR's, Washer, Dryer, Internet, Any Spa's or Pools,
and the Elevator...Etc., herein called"extras", are supplied at no extra charge as a convenience for Guest use.
In the event of a malfunction or breakdown of "extras", Owner or Owner's Representative will have the item repaired as quickly as practical. Guest agrees that there will be no refund for malfunction or
breakdown of "extras". In the event of malfunction of any other appliance or feature, Guest must
notify Owner or Owner's Representative so repair of malfunction can be made. Owner will
expedite repair, but no refund of rent will be made. Please do not re-wire, unplug, change
settings, re-program, or reset/modify any of the Appliances/Water Heaters/pool or Elevator.. Do not attempt to connect any video games, computers, or other electronic equipment to the TVs, networking
equipment, or other Appliance. Any repair work, re-wiring, settings reset, or reprogramming will
result in a $150.00 charge to Guest.
18) Hurricane Policy: No refunds will be given unless a "Mandatory Evacuation Order" for the
local area is issued by local authorities. The day that the authorities declare "Mandatory
Evacuation", we will refund:
Any unused portion of rent from a guest currently registered.
Any unused portion of rent from a guest who is scheduled to arrive and wants to shorten the
stay to come in after the "Mandatory Evacuation" is lifted.
Any prepaid rent collected for a reservation scheduled to arrive during the "Mandatory
Evacuation" period.
If a guest changes his/her reservation in lieu of canceling, we will not charge any service charges
provided that the reservation is changed to other dates that the home is available within the same
or following calendar year as the original reservation.
Please note that similar evacuation orders due to hurricane conditions are relatively rare on the
Georgia coast, but you should consult current forecasts in making your short-term rental
reservations. The refund policy will not apply to inclement weather short of a mandatory
evacuation order.

19) Authorized Use Our home may only be used as a residence. Due to Tybee Island zoning
ordinances, it can not be used to host official functions or special events. The responsible party
signing the rental agreement must be at least 25 years of age and all guests that will be staying at
the home must be listed on the rental agreement. When more than one family are renting the
home together, one person must be responsible for the entire guest party and insure that all
guests are familiar with all applicable rules and regulations during their stay. Fireworks are
prohibited on the property and may not be used on Tybee Island. Any other illegal use of the
home may constitute grounds for cancellation of this Agreement without refund.
20) Noise Ordinance There is a noise curfew on Tybee Island beginning at 10:00 PM. Please be
considerate of our neighbors at all times, especially when using the top decks.
21) Indemnification and Insurance: Guest agrees to indemnify and hold harmless Owner, his
Agents or employees against all loss, damage, expense, and penalty arising from action or
omission of the Guest, other members of the Guest’s party, or visitors of the Guest which cause
injury, loss, or death to any person, or damage to any property. Guest is encouraged to secure
appropriate traveler’s or vacation, or renter’s insurance and/or consult with Guest’s personal
homeowner policy coverages that may cover Guest during their stay.
22) Succession or Assignment: This Agreement is binding on, and the benefits inure to, the
undersigned parties. This Agreement may not be assigned or transferred by Guest without
express written permission of Owner. The property may not be sublet by the Guest.
23) Governance: This Agreement is made in, and shall be governed solely by the laws of the
State of Georgia. If any section, clause, paragraph or term of this Agreement is held or
determined to be void, invalid, or unenforceable, for any reason, all other terms, clauses, and
paragraphs herein shall be severed and remain in full force and effect.

25) Attorney’s Fees and Costs: If Owner must employ the services of an Attorney to enforce
conditions of this Agreement or to collect any amounts due, Guest shall be liable to Owner for
reasonable attorney’s fees and costs as the result of such action.
26) Written Exceptions: Any exceptions to any listed policies must be approved in writing in
advance by management
